FINANÇAMENT LOCAL
PLE SETEMBRE-09. 3 A FAVOR I 8 EN CONTRA
En una situació de greu crisi econòmica com l'actual, garantir l'arribada de recursos suficients als ajuntaments per a poder desenrotllar la seua activitat i prestar els seus servicis, és un problema seriós perquè afecta els més de 8.000 municipis espanyols i abordar la qüestió del finançament local ha de ser una prioritat ja que és un problema comú per al municipalisme espanyol. No obstant això, i a pesar dels greus problemes de finançament que estan patint les corporacions locals en este moment de crisi econòmica, és palès l'escàs compromís amb els municipis espanyols i els esforços de l'Executiu central han anat encaminats en la seua totalitat a tancar el nou model de finançament autonòmic.A pesar de les reiterades promeses, El Govern d'Espanya no sols no ha proposat un nou model de finançament local vinculat i simultani a la reforma del model de finançament autonòmic, tal com s'havia compromés en diverses ocasions, i li ha sol·licitat la FEMP; sinó que recentment el secretari d'Estat de Cooperació Territorial ha anunciat que la Llei de Finançament Local no serà aprovada definitivament fins al 2011.
Junt amb l'anterior, cal afegir que les perspectives del finançament local a curt termini són molt negatives, ja que la major part dels ingressos municipals depenen de la recaptació de l'Estat, que s'està veient molt afectada per la crisi i per les mesures polítiques adoptades pel Govern d'Espanya. En 2010, les entitats locals tindran un menor finançament procedent de l'Estat de, almenys, 3.000 milions d'euros, com a conseqüència de la caiguda tan espectacular de la recaptació en 2008. En 2011, esta xifra s'eleva fins als 4.500 milions d'euros, aproximadament. Açò sense comptar amb el finançament provisional que continguen els Pressupostos Generals de l'Estat per a l'any que ve i el següent, que tal com s'estan comportant els ingressos en 2009, segurament suposaran també una caiguda de les entregues a compte. Per tant, es fa inajornable una reforma del finançament local que garantisca als governs locals la prestació dels servicis essencials que demanden els ciutadans.
A la tardança d'escometre esta reforma se suma la irresponsable política pressupostària del Govern, que provocarà que els ajuntaments hagen de tornar part de les entregues a compte avançat pel Ministeri per a l'exercici 2008.
L'excés d'optimisme i la voluntat d'ocultar la situació real de l'economia per part del Govern ha provocat que els dos últims Projectes de Llei de Pressupostos elaborats per l'executiu estigueren especialment fonamentats en unes previsions macroeconòmiques irreals.
Estes previsions optimistes d'ingressos van permetre al Govern avançar unes bestretes a les entitats locals molt superiors als que correspondrien en cas d'haver realitzat una previsió real.
Les entitats locals van realitzar els seus pressupostos anuals basant-se en les dites previsions optimistes d'ingressos, i van comprometre gasto atenent als recursos facilitats per les entregues a compte del Ministeri d'Economia i Hisenda.
Una vegada realitzada la liquidació definitiva de 2008, el resultat de la qual és negatiu, entitats locals, així com les comunitats autònomes es veuran obligades a reintegrar part dels ingressos a compte rebut per l'Estat per no haver-se complit les seues previsions de recaptació.
No obstant això, mentres que les CCAA, en virtut del nou acord per a la reforma del model de finançament, disposaran d'un termini de mora d'un any, i podran periodificar la cancel·lació del deute en quatre anys, les entitats locals estaran subjectes al sistema ordinari de liquidació.
Per tot això, es proposa al PLE l'adopció dels següents:
ACORDS
PRIMER. S'acorda per la corporació instar el Govern d'Espanya a adoptar urgentment les següents mesures amb caràcter urgent i extraordinari per a l'exercici 2010:
1) 1) Que, a càrrec de l'import del nou Fons Estatal d'Inversió Local per al 2010 (5.000 milions de &euro
, es garantisca el finançament local del pressupost de 2009 en, almenys 3.000 milions de € més que permeta el pagament dels deutes pendents i la prestació dels servicis públics als ciutadans. 2) Que la resta del Fons Estatal d'Inversió Local siga objecte de distribució entre els municipis per mitjà de criteris objectius que atorguen una més flexibilitat en els terminis d'execució i en la finalitat de les obres, de tal forma que estes inversions es destinen a prioritats reals de cada Ajuntament.
3) Que s'incorpore a les diputacions provincials en el nou Fons Estatal d'Inversió Local com a operadors directes i no sols com a cooperants.
4) Que El Govern de la nació torne a les corporacions locals l'import que en concepte d'IVA va gravar en les inversions previstes en l'actual Fons d'Inversió Local de 8.000 milions d'euros, a l'ingressar-se 1.100 milions d'euros d'IVA a l'Estat, per a destinar-ho a gasto corrent dels ajuntaments.
5) Que El Govern de la nació compense als municipis pel cost dels beneficis fiscals obligatoris en els tributs locals o, si no n'hi ha, que es convertisquen en beneficis fiscals potestatius per a aquells.
6) Aplicar transitòriament a les entitats locals el sistema de moratòria en el reintegrament de les liquidacions negatives d'exercicis anteriors que es va a aplicar a les comunitats autònomes de règim comú, arran del recent acord per a la reforma del model de finançament autonòmic.
SEGON: Abonar al Consell en el seu reclam davant del Govern d'Espanya que el nou sistema de finançament local, amb independència del moment en què s'aprove, s'aplique des del mateix moment en què ho siga el model de finançament autonòmic, entre les línies bàsiques del qual han de trobar adequada cabuda les següents:
- - Que es consoliden com a recursos addicionals del nou model de finançament local, almenys, els 3.000 milions de € de garantia del finançament de l'exercici 2009.
- Que El Govern d'Espanya garantisca, com a recursos de caràcter incondicionat, el desplegament efectiu de les Participacions en Ingressos de les comunitats autònomes en tot el territori nacional d'acord amb criteris homogenis i coordinats, tot això sense perjuí de les especialitats que puguen introduir les comunitats autònomes en l'exercici legítim de la seua autonomia.
- Que El Govern d'Espanya procedisca a la modificació del sistema tributari local, dotant-lo d'elements més dinàmics, vinculats a la realitat econòmica, en els termes acordats per unanimitat en el Senat al desembre del 2007.
TERCER: S'acorda per la corporació instar al Consell de La Generalitat a mantindre la col·laboració amb els ajuntaments i a continuar impulsant el municipalisme com a fórmula eficaç per al desenrotllament econòmic dels municipis de la Comunitat Valenciana.
